JUDGMENT
The claim of discrimination on the grounds of race and/or religion and/or belief or harassment in connection with the claimant’s alleged (constructive) unfair dismissal, having been withdrawn by the claimant, is dismissed under Rule 52 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013. The claimant did not, pursuant to Rule 52 (a), express at the time of withdrawal at the hearing on 8 August 2023, a wish to reserve the right to bring such further claims raising the same or substantially the same complaint. The parties were invited and made representations on whether to issue a Rule 52 judgment would not be in the interests of justice under Rule 52 (b) however, for reasons given orally to the parties at the hearing on 7 November 2023, the Tribunal considered that it was in the interests to do so.
