JUDGMENT
[1]The Claimant’s application to amend her claim is granted. The Claimant has leave to amend her claim in accordance with the schedule of allegations contained in a table setting out 11 allegations and more particularly found at pages 50 – 57 of the bundle for today's hearing.[2]The amendment is granted subject to the Respondent having the right to argue any out of time point at the final in line with the decision in Galilee v The Commissioner of The Police of The Metropolis [2017] UKEAT/0207/16/2211[3]The Claimant’s allegations of direct race discrimination, victimisation or harassment as set out at number 11 in the list of allegations (found at page 57 of the aforementioned schedule) is struck out as having no reasonable prospect of success.[4]The Respondent's applications to strike out the amended claim on the grounds that the Claimant has failed to comply with case management orders and on the grounds that the amended claim has no reasonable prospect of success are refused.[5]The Respondent’s application for a deposit order in respect of the amended claim is refused.
