Practicable enquires were made by the Employment Tribunal about the reasons for his absence and the decision was then taken to proceed with the hearing in his absence pursuant to Rule 47.[2]The claims of unlawful deductions from wages brought pursuant to section 13 Employment Rights Act 1996 and/or claim for holiday pay pursuant to the Working Time Regulations 1998 are not well founded and are dismissed un their entirety.
