The claim is struck out.REASONS
[1]By a claim presented in the Midlands (East) Employment tribunals on 1 November 2023, the claimant complained of unfair dismissal.[2]Section 108 of the Employment Rights Act 1996 requires a claimant to have not less than two years service to make an unfair dismissal complaint. The claimant was employed by the respondent for less than two years. Therefore the claimant is not entitled to bring these proceedings unless one of the exceptions applied.[3]Be notice dated 12 December 2023 the claimant was informed and given until 3 January 2024 to give reasons why the claim should not be struck out.[4]The claimant has failed to give any response or any reason why the complaint should not be struck out.[5]Accordingly, the claim is struck out.
