[1]The Claimant was unfairly dismissed by reference to s.98 Employment Rights Act 1996 but not by reference to s.103A Employment Rights Act 1996.[2]A Polkey reduction of 20% shall apply to any compensatory award.[3]The Claimant did not contribute to his dismissal by any blameworthy conduct.[4]The Claimant was wrongfully dismissed. RECONSIDERATION JUDGMENT 1. Upon considering the Claimant’s application, made immediately following judgment, that the tribunal reconsider and revoke it’s above judgment as to Polkey, the judgment as to Polkey is confirmed.
