JUDGMENT
UPON both parties failing to comply with the case management orders made by the tribunal. AND UPON the respondent accepting that the claimant had 9.5 days annual leave outstanding at the date of termination. AND UPON the tribunal declining jurisdiction to determine the employer’s contract claim on the ground that there was no breach of contract claim presented by the claimant (Read v Ryder [2019] ICR Digest D5 applying). AND UPON the Respondent agreeing not to pursue the claimant for any overpayments in the County Court or otherwise. AND UPON the respondent voluntarily undertaking to provide the claimant with copies of her past payslips throughout the period of employment. BY CONSENT OF THE PARTIES, the tribunal gives judgment that: -[1]The claimant’s claim for accrued holiday pay outstanding at the date of termination succeeds. The respondent shall pay compensation to the claimant in the sum of £582.90 Case number: 2602444/2021[2]The claim of unauthorised deduction from wages is dismissed on withdrawal.[3]The claim of failure to provide written statement of pay is dismissed on withdrawal.
