JUDGMENT
[1]The claimant’s claim for breach of contract is dismissed.[2]The claimant may amend his claim to bring a claim for direct race discrimination (Equality Act 2010 section 13 and Part 5).[3]The respondent’s application to strike out the amended claim for direct race discrimination (rule 37(1)(a)) is dismissed.REASONS
[1]The claimant was ordered to pay a deposit of £275 following a preliminary hearing held on 1 November 2019. The Order was sent to the claimant on 14 November 2019. The claimant has failed to pay this deposit. The complaint of Race Discrimination is therefore struck out under rule 39(4) of the Employment Tribunals Rules of Procedure 2013.[2]Because there are now no claims before the Tribunal, the Tribunal will not list any further hearings in this case.
