JUDGMENT
[1]The claimants’ claims for unauthorised deductions from wages succeed.[2]The claimants’ claims for compensation for accrued but untaken annual leave outstanding at the date of termination succeed.[3]The claimants’ claims for breach of contract succeed.[4]The remedy that each claimant is entitled to will be determined at a remedy hearing.REASONS
[1]By email dated 07 December 2023 the Tribunal gave the respondent an opportunity to make representations or to request a hearing, as to why the response should not be struck out because it has not been actively pursued.[2]The respondent has failed to make representations why this should not be done or to request a hearing. The response is therefore struck out and judgment on liability entered for the claimants.[3]The remedy that the claimants are entitled to will be determined at a remedy hearing. Notice of that hearing will follow.[4]The respondent will be entitled to notice of any hearings and decisions of the Tribunal but will only be entitled to participate in any hearing to the extent permitted by the Employment Judge. If the respondent wishes to participate in the remedy hearing it should apply promptly.
