The second respondent’s response is struck out.REASONS
[1]The second respondent has not attended hearings or corresponded for some time.[2]The second respondent has not complied with case management orders.[3]The second respondent did not attend the urgent preliminary hearing on 26 February 2025. At the conclusion of that hearing, a strike out warning was given directed at him.[4]The second respondent did not respond to that warning.[5]Accordingly, I am satisfied the second respondent is not actively pursuing his response and that it is just for it to be struck out for that reason. Employment Judge Clark Date: 5 March 2025[1]The claim against the 3rd Respondent is dismissed because there are no allegations raised against him.[2]The claims of direct disability discrimination, harassment related to disability and victimisation against all Respondents fail and are dismissed.[3]The claim of automatically unfair dismissal fails and is dismissed.
