[1]The correct name of the respondent is The Eco Roof and Wall Company Limited (in administration).[2]The claimant’s claim of unfair dismissal is dismissed upon its withdrawal by the claimant.[3]The claimant’s claim for a statutory redundancy payment is dismissed upon its withdrawal by the claimant.[4]The claimant’s claim of unauthorised deduction of wages is dismissed.[5]The claimant’s claim for breach of contract (failure to pay notice pay) succeeds. The respondent shall pay the claimant one week’s pay calculated as £25,000 per annum divided by 52 weeks = £480.79 (gross without deduction of tax or national insurance).[6]The claimant’s claim of failure to pay holiday pay succeeds.
