The claim is struck out.REASONS
[1]This case was listed for Preliminary hearing on 30/1/2019 and the Claimant failed to attend. Employment Judge Dyal ordered the Claimant to explain his nonattendance and whether he intended to pursue his claim by no later than 13 February. He failed to do so. On 8 March 2019 Employment Judge Ahmed informed the Claimant that he was considering striking out the claim on account of his failure to comply with the above orders. The Claimant was given until 22 March to provide his objections in writing. He failed to do so. On 31 March the Tribunal office received from the Claimant a short email claiming that he was suffering memory loss, on account of medication taken for an unspecified illness, and that the ‘Ahmed’ email had not been seen due to being in his ‘spam box.’ Having considered the matter with care and taking into account the whole history of this case, I have concluded that it is appropriate to strike out the claim on the basis of a) non-compliance & (b) not being actively pursued. The claim is accordingly struck out.[2]The hearing fixed for 28 - 30/10/2019 will not take place. 12/4/19
