JUDGMENT

[1]The Respondent has made unauthorised deductions from the Claimant’s wages and is ordered to pay the Claimant the sum of £1,415.25. When these proceedings were begun the Respondent was in breach of its duty to give a written statement of employment particulars and so the amount deducted (£1,100.75) has been increased by 2 weeks’ pay (£314.50) as required by section 38 of the Employment Act 2002.[2]The Claimant was dismissed in breach of contract because she was not given notice and the Respondent is ordered to pay damages to the Claimant in the sum of £157.25.[3]The Respondent has failed to pay the Claimant’s holiday entitlement and is ordered to pay the Claimant the sum of £183.35.[4]The Claimant’s claim of unfair dismissal is dismissed because she had not completed 2 years’ employment on the date of the termination of her employment.
