JUDGMENT
[1]The claim of constructive unfair dismissal succeeds. The Respondent will pay the Claimant by way of overall compensation and having allowed for the contribution that I have found to be the case, the net sum of £1,582.51. This includes an award of 12.5% = £175.83 pursuant to section 207A of TULRCA it being just and equitable in all the circumstances to make that uplift.[2]The claim for breach of contract (wrongful dismissal) succeeds and the Respondent will pay the Claimant damages by way of 2 weeks’ notice pay in the sum of £733.48.[3]This makes a total award of £2,315.99.
