Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The claimant was dismissed in breach of contract in respect of notice and the respondent is ordered to pay damages to the claimant in the sum of £3354.52.[2]The claimant was dismissed by reason of redundancy and is entitled to a redundancy payment of £6381.69.For the benefit of the Secretary of State and payment from the Insolvency Fund pursuant to s166 of the ERA 1996, the calculation is as follows. DoB 22/1/63. Length of service 11 completed years. Age at the EDT (9/9/17) = 54. Thus entitlement is 16.5 per weeks gross pay. Gross pay = £1676 x 12 = £386.77 x 16.5 = £6381.69.52[3]I direct that a copy of this judgment be sent to the Secretary of State.
