The claim is struck out.REASONS
[1]The claimant failed to participate in a telephone preliminary hearing on 10 September 2019. A full chronology of the case was set out in the case management summary.[2]Although it appeared unlikely that the claim was being pursued, I was reluctant to strike out the claim at that hearing. Instead I gave the claimant opportunity to contact the tribunal and explain his absence and confirm he wished his claim to continue. I warned the claimant that I was contemplating striking it out otherwise.[3]The claimant has failed to reply to the tribunal by the due date of 20 September 2019. There has been no belated response in the time between then and today, when the file has been referred to me but the respondent has now applied for strike out. Having reviewed the matter once again, I am satisfied that it is now proportionate to strike out the claim for the reasons that:-• the claimant had not complied with the Order of the Tribunal dated 10 September 2019.• The claim has not been actively pursued.
