JUDGMENT

[1]The claimants were not, at the date of the insolvency, employees of the second respondent within the meaning of section 230 Employment Rights Act 1996.

[2]The claimants’ claims against the second respondent for unpaid redundancy pay, unpaid holiday pay and unpaid wages therefore fail and are dismissed.

[3]The claimants’ claims that the Secretary of State (R2) is liable to make payments to them pursuant to s166/182 Employment Rights Act 1996 is not well founded and is dismissed. Case numbers: 2601677/2023 and 2601678/2023
