Mr D Midgley v Planning Solutions: 2601666/2023
JUDGMENT
The complaint of unfair dismissal is struck out.REASONS
[1]By an Order made on 13 November 2023 and sent to the parties on 14 November 2023 the Tribunal gave the claimant an opportunity to make representations as to why the complaint of unfair dismissal should not be struck out because(1) the Claimant does not have the qualifying period of service of two years’ service as required by section 108 Employment Rights Act 1996(2) it appears the Claimant has not actively pursued his claim and(3) he has failed to comply with case management orders.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The complaint of unfair dismissal is therefore struck out.[3]The hearing on 2, 3 and 4 June 2025 is cancelled.
