Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The first claim was issued in the East Midlands Employment Tribunals on 14 July 2021 having been presented on the 7July 2021. The second claim was presented on the 8 September 2021 and issued on the 20 September 2021. Both are for notice pay and unpaid holiday. The Claimant quantified what was due in the second claim. The two claims were consolidated on the 20 September 2021. The Respondent has failed to present a valid response on time or at all to either claim. The Employment Judge has decided that a determination can properly be made of the claim, or part of it, in accordance with rule 21 of the Rules of Procedure.[2]The Claimant was dismissed in breach of contract in respect of notice and the Respondent is ordered to pay damages to the Claimant of £732.36 net.[3]The Respondent has failed to pay the Claimant’s holiday entitlement and is ordered to pay the claimant £121.50.[4]Therefore the respondent must pay the claimant £853.86 in total.[5]The hearing listed on 19/11/2021 is cancelled.
