JUDGMENT

UPON hearing from the claimant in person and the respondent not attending AND UPON considering the Tribunal’s file and evidence filed by the claimant AND UPON concluding the claimant’s employment did not transfer to Olivia Lux Ltd either on 17 February 2024 or at any other time IT IS THE TRIBUNAL’S JUDGMENT THAT[1]The respondent dismissed the claimant because she was redundant, and therefore the respondent owes to the claimant the sum of £1,440 by way of redundancy payment.[2]The claims for 2.1. unauthorised deductions from wages, 2.2. unpaid holiday pay, and 2.3. notice pay were presented out of time. It was reasonably practicable to have presented them in time. Therefore the Tribunal lacks jurisdiction to hear and decide them, and so each of them is dismissed. Page 1 of 2 Case No 2601503.2023
