JUDGMENT

UPON hearing from the representative for the claimants UPON the first respondent having failed to present a response and therefore being debarred from taking part UPON the second respondnet not attending but having made written submissions UPON considering those written submissions AND UPON cosnidering the evidnece filed IT IS THE TRIBUNAL’S JUDGMENT THAT[1]Each claimant’s complaints under Trade Unions and Labour Relations (Consolidation) Act 1992 [“TULCRA”] section 189 of a failure by the first respondent to comply with the requirements of TULCRA section 188 is well-founded; and so[2]The first respondent must pay a protective award equivalent to remuneration for the period of 90 days beginning on 11 September 2025 (“the dismissal date”) to each claimant. The parties’ attention is drawn to the notes at the end of this judgment, particularly those relating to the obligations now on the first respondent and the effect of the regulations.
