JUDGMENT

[1]The claim of disability discrimination is dismissed upon withdrawal.[2]The claims for breach of contract; non payment of wages and outstanding holiday pay are also dismissed upon withdrawal.[3]The application to amend having been granted, the claims that proceed are for detrimental treatment based upon whistleblowing pursuant to s 47B and constructive dismissal also based upon whistleblowing pursuant to s103A in each respect pursuant to the Employment Rights Act 1996.

REASONS

[1]By a letter dated the 21st June 2023 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because: it has not been actively pursued.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The claim is therefore struck out.[3]The hearing fixed for the 22th April 2024 to the 24th April 2024 will not take place.
