Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The claimant was dismissed in breach of contract in respect of notice and the respondent is ordered to pay damages to the claimant for the 3 weeks notice pay outstanding (net wage =£1509 x 12 = £382.23 x 3) in the sum of £ 1146.69. 52[2]The claimant was dismissed by reason of redundancy and is entitled to a redundancy payment of (gross wage = £1833 x 12 = £423. Age at EDT = 48. Years of continuous service = 4. 52 Thus RPT = 6 x £423) = £2538. S166 of the ERA 1996 applies to this part of the award thus enabling the Claimant to apply for payment from the Insolvency Fund.[3]The hearing listed on 26/1/18 is cancelled.
