JUDGMENT
[1]The claim of breach of contract succeeds. The claimant was dismissed without the notice due to him under the contract of employment. There is no order for damages as the claimant was paid a sum in lieu of notice equivalent to the earnings he would have received and has suffered no loss as a result of the breach.[2]The claim for accrued but untaken annual leave outstanding at the date of termination is dismissed as all of the claimant’s accrued entitlement had been paid to him.
