JUDGMENT

The claim against the above named Respondent is struck out.

REASONS

[1]The First Respondent company has been dissolved and the Claimant has not successfully applied to have it restored to the Register of Companies (“The Register”).[2]On 28th May 2024 the Tribunal gave the Claimant an opportunity to give written reasons why the claim should not be struck out as it had not been actively pursued. The Claimant has failed to give an acceptable reason and stating that he is unable to take the necessary steps to have the First Respondent restored to the Register.[3]The claim against the First Respondent cannot proceed without the Claimant taking that step and so it is not being actively pursued and is therefore struck out.[4]This does not affect the Claimant’s claim against the Second Respondent, Frederick Blake t/a EPS Security Ltd.
