JUDGMENT
[1]The complaint of unfair dismissal is struck out on the basis that the Tribunal has no jurisdiction to entertain it.[2]It is just and equitable to extend time to allow the complaints of age and race discrimination to proceed out of time.[3]Case Management Orders are attached. _____________________________ Employment Judge Heap Date_30th November 2018REASONS
[1]On 6th December 2018 I gave notice to the parties that I was giving consideration, on my own initiative, to reconsidering the Judgment sent to the parties on 5th December 2018 to also strike out the complaint of breach of contract for want of jurisdiction given that the same considerations would apply to that complaint as had given rise to the striking out of the unfair dismissal complaint expressly referred to in the Judgment.[2]The parties were given 14 days to object. No objections have been received whether within that time frame or at all.[3]Given the reasons for proposing that there be a reconsideration in the above terms, I consider it to be in the interests of justice to vary the Judgment and therefore do so to also strike out the complaint of breach of contract with regard to notice or notice pay.[4]The complaints of age and race discrimination remain unaffected by this decision.
