JUDGMENT

Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The respondent has made an unauthorised deduction from the claimant's wages and is ordered to pay the claimant the sum of £3354.90 net. This is not grossed up as the claimant has not provided the calculation.[2]The claim of breach of contract in respect of unpaid fuel allowance succeeds, the respondent is ordered to pay damages to the claimant in the sum of £425.00[3]The respondent has failed to pay the claimant’s holiday entitlement and is ordered to pay the claimant the sum of £1210.78 gross.[4]The claim for failure to provide written statement of particulars of employment succeeds. Pursuant to s 38 (3) and (4) of the Employment Act 2002 the respondent is ordered to pay the claimant compensation of four weeks pay, namely £899.00, it being just and equitable in all the pleaded circumstances to so award.[6]The hearing listed on 3/11/2017 is cancelled.
