JUDGMENT

The claimants claims are struck out.

REASONS

[1]By an order of EJ Cansick sent to the parties on 17 October 2024, the claimants were informed that the Tribunal was considering striking out their claims. The order gave them an opportunity to make representations or to request a hearing, as to why the claim should not be struck out. The judge explained the reason for the warning was that the claimants had not complied with directions, had not completed an agenda for the preliminary hearing and then did not attend that preliminary hearing. As such he considered the claims appeared to be claims that were not being actively pursued.[2]The claimants have failed to make representations in writing why this should not be done or to request a hearing. The claims are therefore struck out.[3]The hearing fixed for 9, 11, 12 February 2026 will not take place.
