Mr P Bowley v Creed Food Services: 2600999/2022
JUDGMENT
The claim is struck out.REASONS
[1]By a letter dated 31st May 2022 the Tribunal gave the Claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because it has no reasonable prospect of success. That is because the Claimant has entered into a binding agreement to settle the claim via ACAS.[2]The Claimant has made representations as to why the claim should not be struck out but those are insufficient given that they do not address the fact that he no longer has standing to bring the claim now that he has entered into a binding settlement agreement. The claim is therefore struck out because it has no reasonable prospect of success.
