JUDGMENT
UPON the claimant not attending but making written representations and presenting evidence in support of her claims presented to the Tribunal on 18 May 2022 in the Midlands (East) region AND UPON the respondent failing to present a response and therefore being barred from taking part in the proceedings without permission AND UPON the respondent not seeking permission to take part AND UPON considering the representations and evidence presented to the Tribunal AND PURSUANT to rule 21 of the Tribunal’s rules IT IS DECLARED AND ORDERED THAT[1]The respondent has made unauthorised deductions from the claimant’s wages. The respondent must therefore pay to the claimant the sum of £864.50 gross,[2]In addition, the respondent has failed to pay the claimant for leave to which she was entitled to payment. The respondent must therefore pay to the claimant the sum of £308.75 gross,[3]The claim for holiday pay for leave to which the claimant was entitled but which was not taken at the time her employment ended is dismissed. To award a sum would be guesswork and unsupported by any evidence.
