JUDGMENT
After considering the documents filed, the Tribunal file, evidence on behalf of both parties and after considering the parties’ arguments[1]The Tribunal strikes out the claimant’s claim for direct discrimination because of disability (Equality Act 2010 section 13) because it has no reasonable prospect of success (rule 37(1)(a)).[2]The Tribunal dismisses the respondent’s application to strike out the claimant’s claim for unfavourable because of something arising as a consequence of a disability (Equality Act 2010 section 15) which was made on the basis it has no reasonabe prospect of success (rule 37(1)(a)).[3]The Tribunal dismisses the respondent’s application to strike out the claimant’s claim for unfair dismissal (Employment Rights Act 1996 section 111) which was made on the basis it has no reasonabe prospect of success (rule 37(1)(a)).
