JUDGMENT
The claim of a failure to pay a redundancy payment succeeds and the Respondent is ordered to pay to the Claimant the sum of £813.40.REASONS
[1]I am satisfied with the evidence that Miss Robertson has given me that she agreed with the persons responsible for running the business that she would stay to see that the business was wound up.[2]At the point the business was wound up (ie 31 August 2017), Miss Robertson was still an employee. Therefore, applying section 136 of the Employment Rights Act 1996, she is entitled to a redundancy payment.[3]That payment is calculated as follows:• She has 3 continuous years of service, ie between 1 June 2014 and 31 August 2017.• She was born on 20 April 1975.• Her gross weekly wage was £232.40 and the multiplier, having regard to her age is 3½.
