The claim of unfair dismissal is dismissed for lack of jurisdiction.REASONS
[1]The basis of the claim was discussed as a closed preliminary hearing.[2]The claimant had less than 2 years’ continuous service at the date of termination.[3]The claimant explained the claim was based on factors which would engage the ordinary principles of fairness contained in section 98 of the Employment Rights Act 1996.[4]That is a claim requiring two years’ continuous service. The exceptions to that requirement were explored and none were engaged in the facts of this claim. For that reason, the tribunal does not have jurisdiction to determine the claim of unfair dismissal.
