JUDGMENT

The claim was an appeal against notices of underpayment issued under the National Minimum Wage Act 1998 as amended. During the course of the proceedings, the respondent has withdrawn those notices. The claimant therefore withdrew the appeal, but applied for an order that the respondent pay the claimant’s costs of the appeal. The parties have concluded terms of settlement between them in relation to the claim and said application for costs, as set out in the order below. The parties consented to that order and asked the Tribunal to make such an order. AND BY CONSENT THEREFORE IT IS ORDERED THAT:[1]The claim is dismissed because the claimant has withdrawn it;[2]The claimant’s application for costs is dismissed;[3]The claimant shall pay the respondent’s costs of the application in the agreed sum of £1,200 by the agreed date of 7 June 2022.
