JUDGMENT
[1]The following complaints of disability discrimination are dismissed on the basis that they were brought after the end of the period of three months starting with the date of the act to which the complaint relates and not within such other period as the employment tribunal thinks just and equitable: 1.1. The complaint of discrimination arising from disability, alternatively indirect disability discrimination, related to the disciplinary warning given to the Claimant on 15 November 2016; 1.2. The complaint of discrimination arising from disability, alternatively indirect disability discrimination, related to the disciplinary hearing held in respect of the Claimant on 26 July 2017; and 1.3. The complaint of failure to make reasonable adjustments related to the Respondent’s alleged failure to carry out a risk assessment in respect of the Claimant in the period 26 July 2017 to 3 November 2017.[2]The remaining complaints of disability discrimination and the complaint of unfair dismissal will be heard at a final hearing.
