The response is struck out.REASONS
[1]By a letter dated 04 October 2024 the Tribunal gave the respondent an opportunity to make representations or to request a hearing, as to why the response should not be struck out because• the respondent had not complied with the Order of the Tribunal dated 14 May 2024.• it has not been actively pursued.[2]The respondent has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The response is therefore struck out.[3]The respondent will be entitled to notice of any hearings and decisions of the Tribunal but will only be entitled to participate in any hearing to the extent permitted by the Employment Judge. _____________________________ Employment Judge Ahmed Date: 30 October 2024[1]The Claimant’s claim of unfair dismissal is well-founded.[2]The Respondent shall pay the sum of £1,368 to the Claimant as a basic award for unfair dismissal.[3]The Respondent shall pay the sum of £10,964 to the Claimant as a compensatory award for unfair dismissal, formed of the following components: (1) Past loss of earnings in the sum of £10,964.[4]The recoupment provisions apply:(1) The prescribed element is £10,964.(2) The prescribed period is 2 February 2023 to 17 March 2025.(3) The total award is £10,964. Case No. 2600715/2023(4) The balance is £0.[5]It is declared that the Respondent made unauthorised deductions from the Claimant’s wages on 18 weekly occasions for payment in the period 30 September 2022 to 1 February 2023. The Respondent is ordered to pay compensation to the Claimant for the unauthorised deductions in the gross sum of £4,104 (representing 18 multiplied by the properly payable weekly sum of £228).[6]The Claimant’s claim for a compensation payment in respect of accrued but untaken annual leave as at the effective date of termination (holiday pay) succeeds. The Respondent is ordered to pay to the Claimant compensation in the gross sum of £615.60.[7]The Claimant’s claim for notice pay (breach of contract) is dismissed.[8]The Claimant’s claim for a statutory redundancy payment is dismissed upon its withdrawal by him.
