JUDGMENT
AT AN ATTENDED OPEN PRELIMINARY HEARING HAVING considered the Grounds of Resistance filed on behalf of all four Respondents, AND HAVING considered the application under Rule 20, UPON reading the witness statement of Simran Kareer and the representations made on behalf of the Claimant, and UPON the Respondents completing the Response Forms today (without the Grounds of Resistance which were lodged earlier) and HAVING considered the reasons given by the Respondents for the delay and Case No: 2600711/2021 Page 2 of 3 HAVING determined that it is in the interests of justice to extend time, the time for all four Respondents to submit their Response is extended to 19 July 2021 and the time for formal completion of the Response Form is extended to today:[1]The Rule 21 Judgment made on 5 July 2021 and sent to the parties on 6 July 2021 is set aside and all of the Respondents have leave to defend these proceedings;[2]The full merits hearing shall now take place over 5 days on 9, 10, 11, 12 and 13 January 2023 at the Leicester Hearing Centre, 6A New Walk, Leicester, LE1 6TE commencing at 2.00pm on the first day and at 10.00am on the remaining days. The parties should take this as notice of that hearing.[3]A Preliminary hearing will be conducted by an Employment Judge by telephone commencing on Wednesday 25 May 2022 at 10:00 am. It has been given a time allocation of 90 minutes. [1]By a letter dated 8 June 2022 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because• it has not been actively pursued.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The claim is therefore struck out.[3]The hearing fixed for 9-13 January 2023 will not take place.
