[1]During her evidence Miss Steel-Clelland asserted that the signatures on documents 41, 43, 46, 50, 51, 53 58 and 60 from the trial bundle were not hers. Those documents have a significant bearing on the preliminary issue we were dealing with, namely whether Miss Steel-Clelland has sufficient continuous service to bring a claim under Section 94 of the Employment Rights Act 1996.[2]Whether the signatures are hers will also affect credibility.[3]She also gave evidence to the effect that all the learning she acquired whilst working on the Respondent’s first floor rather than the BMMA premises.[4]Ms Alam applied to adjourn and Mr Anastasiades opposed. Having regard to the overriding objective we had no choice but to adjourn given that neither assertion emerges from either the claim form or the witness statement. It was agreed that:-4.1 The parties would jointly instruct a hand-writing expert to consider the documents listed above.
