JUDGMENT

The Employment Tribunal Judge gave judgment as follows:-[1]The claim of religious philosophical belief discrimination is dismissed upon withdrawal.[2]The application to amend the claim of race discrimination is dismissed. The residual claim is automatically dismissed by reason of the Claimant having failed to comply with the Unless Order of Employment Judge Broughton.[3]The Claimant’s application for joinder of Tina O’Sullivan and others is refused.[4]A separate Order is hereby issued as to the amount of the deposits and the deadlines for payment.[5]This matter is hereby listed for a further open attended hearing currently by CVP on 3 February 2021 commencing at 10 am with a time estimate of 1 day.[6]This employment judge recuses himself from presiding at further hearings in the matter.

REASONS

[1]The Claimant has failed to pay any of the three deposit orders ordered by EJ Britton at the hearing on 30 October 2020, those orders having been issued on the 10 December 2020 and thus requiring payment by 28 days therefrom, those claims are automatically struck out pursuant to rule 39 (4) of the Employment Tribunals 2013 Rules of Procedure.[2]Thus, as there are otherwise no remaining claims, the proceedings are at an end.[3]The hearing scheduled for 3 February 2021 is cancelled."
