Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The claimant was dismissed in breach of contract in respect of notice and the respondent is ordered to pay damages to the claimant in the sum of £1590.[2]The claimant was dismissed by reason of redundancy and is entitled to a redundancy payment of (age at EDT = 59; length of completed years service = 3; gross weekly wage =- £442.15) = £1989.68. For the benefit of the Secretary of State and thus payment from the Insolvency Fund s166 of the Employment Rights Act 1996 applies to this element of the award.[4]The respondent has failed to pay the claimant’s holiday entitlement and is ordered to pay the claimant the sum of one days pay net £73.38.[5]The hearing listed on 7/9/18 is cancelled.
