UPON hearing from the claimant in person and the representative for the respondent AND UPON the second respondent and third respondent having failed to present responses to the claim and therefore being barred from taking part in proceedings without the Tribunal’s permission AND UPON neither the second nor third respondent having sought permission to take part AND UPON considering the evidence presented to the Tribunal IT IS THE TRIBUNAL’s JUDGMENT THAT[1]The first respondent’s title is amended to The Secretary of State for Business and Trade;[2]There was no transfer of the claimant’s employment from the second respondent to the third respondent;[3]At the time that the claimant’s employment terminated, she was employed by the second respondent;[4]The second respondent Page 1 of 2 Case No 2600619/2024 4.1. has made an unauthorised deduction from the claimant’s wages and therefore must pay to the claimant the sum of £478.47 gross; and 4.2. has failed to pay to the claimant her holiday pay and must therefore pay to the claimant the further sum of £431.61 gross.
