JUDGMENT

It was reasonably practicable to present the claim in time. The complaint of unfair dismissal is struck out.[2]It is not possible to determine the out of time complaint in relation to the complaints of disability discrimination and victimisation. The issue of whether the disability discrimination and victimisation complaints have been presented out of time shall be determined at the final hearing, if necessary.[3]The case is listed for a Preliminary Hearing on Friday 18 March 2022 at 11.00am at the Leicester Hearing Centre and by CVP to determine whether the Claimant was a disabled person and whether the complaints of disability discrimination have reasonable prospects of success.
