The claim is struck out.REASONS
[1]By a letter dated 01 June 2023 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because• You failed to respond to correspondence from the respondent’s representative in preparation for the case management preliminary hearing on 30 May 2023.• You failed to comply with the case management order requiring you to serve on the respondent a schedule of loss by 16 May 2023, and it appears that the manner in which the proceedings have been conducted by you has been unreasonable (see rule 37(1)(b) of the Employment Tribunal (Constitution and Rules of Procedure) Regulations 2013 (“the Rules”),and you have not complied with the Order of the Tribunal dated 4 April 2023 (see rule 37(1)(c) of the Rules), and it appears that the claim has not been actively pursued (see rule 37(1)(d) of the Rules).• You failed to attend the case management preliminary hearing on 30 May 2023 without any reason or without making any application to postpone the hearing.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The grounds set out in the warning are made out. The claim is therefore struck out.[3]The hearing fixed for 11, 12 and 13 November 2024 will not take place.
