JUDGMENT
[1]The claim for unpaid wages (both as an unlawful deduction of wages claim under section 13 Employment Rights Act 1996 and breach of contract claim) for the period 22 November to 7 December 2022 is well founded and succeeds. The respondent is ordered to pay the claimant the sum of £166.25 gross (the claimant was ready and willing to work during that period and he is entitled to this sum calculated at the agreed hourly rate of £9.50 per hour for 2 days per week and for 3.5 hours per day);[2]The claim for notice pay is also well founded and succeeds. The claimant had 3 years continuous service and was entitled to a minimum of 3 weeks notice pursuant to section 86 Employment Rights Act 1996. The respondent is ordered to pay the claimant the sum of £199.50 gross for the period 7 December 2022 (the date notice was issued) to the 28 December 2022; and[3]The claimant is also awarded a further 2 weeks pay pursuant to section 38 Employment Act 2002 and the respondent is ordered therefore to pay the claimant a further sum of £133 gross.
