JUDGMENT
The decision of the Tribunal is that the Respondent’s application to strike out the claim is refused. Case management orders for the future conduct of the case are given separately.REASONS
[1]By an Order dated 8 September 2021 the Tribunal granted the Claimant an extension of time until 22 September 2021 to comply with the Tribunal’s orders of 17 May 2021. A further extension of time was subsequently granted until 19 October 2021.[2]It is appropriate to strike out the claim because:2.1 the claimant has not complied with the Order of the Tribunal dated 17 May 2021 despite the extensions of time.2.2 it has not been actively pursued.[3]The hearing fixed for 7, 9, 14,16-17,21, 23-24, 28 and 30 November 2022 will not take place.
