Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The claimant was dismissed in breach of contract in respect of notice and the respondent is ordered to pay damages to the claimant in the sum of £1605.[2]The respondent has failed to pay the claimant’s holiday entitlement and is ordered to pay the claimant the sum of £2462.79.[3]The claimant was unfairly dismissed. The respondent shall pay to the claimant total compensation of £3,528.90 made up of a basic award of £1605 and a compensatory award of £11650.40 of which £11350.40 is compensation for financial loss.[4]The Employment Protect (Recoupment of Benefits) Regulations 1996 apply as follows. a) The monetary award is £13,255.40 b) The amount of the prescribed element is £11,650.40 c) The dates of the period to which the prescribed element applies are 29 October 2020 to 1 April 2021. d) The amount by which the monetary award exceeds the prescribed element is £1905.[5]The hearing listed on 14/06/21 is cancelled.
