JUDGMENT

[1]The claimant’s claim that the respondent failed to pay to him holiday pay due on termination of employment is dismissed on having been withdrawn by the claimant;[2]The claimant’s claim that he was constructively unfairly dismissed was presented to the tribunal out of time when it was reasonably practicable for it to have been presented in time; the tribunal does not have jurisdiction to hear the claim which is dismissed;[3]The claimant’s claim of disability discrimination was presented to the tribunal out of time in circumstances when it would not be just and equitable to extend time to the date of its presentation; the tribunal does not have jurisdiction; the claim is dismissed.
