Employment Tribunals Rules of Procedure 2013 – Rule 21 The decision of the Employment Judge is:[1]The Respondent made an unauthorised deduction from the Claimant's wages in November 2020 in the amount of £3,541.66 gross. The Claimant is required to give credit for £1,844.57 received from the Insolvency Service and the Respondent is, therefore, ordered to pay the Claimant the gross sum of £1,697.09.[2]The Claimant was dismissed in breach of contract in respect of notice. He is entitled to a net payment of £597.92. The Claimant is required to give credit for £387.80 received from the Insolvency Service and the Respondent is, therefore, ordered to pay damages to the Claimant in the sum of £1,210.12 (being the net amount due).[3]The Respondent has failed to pay the Claimant’s holiday entitlement and the Respondent is, therefore, ordered to pay the Claimant the gross sum of £1,239.49.
