[1]The claimant’s claim includes a complaint of unfair dismissal.[2]Section 108 of the Employment Rights Act 1996 requires a claimant to have not less than two years’ service to make an unfair dismissal complaint. The claimant was employed by the respondent for less than two years.[3]The claimant has responded to the notice to give his reasons for the claim proceeding. Those reasons do engage with matters relevant to his discrimination claim, but not the unfair dismissal claim. They do not, therefore, explain, why that complaint should not be struck out.[4]Accordingly, the claim of unfair dismissal is struck out.[5]The claim in respect of religion or belief continues.
