The Judgment of the Employment Tribunal is as follows:[1]The claimant’s claim under Section 13 of the Employment Rights Act 1996 for the unauthorised deduction of wages is well-founded. The respondent is ordered to pay to the claimant the sum of £1438.64. This is a gross award and the claimant shall be liable to the Inland Revenue for any tax and national insurance payments thereon.[2]The claimant’s claim for holiday pay under he provisions of the Working Time Regulations 1998 is well-founded. The respondent is ordered to pay to the claimant the sum of £793.50. This is a gross award and the claimant shall be liable to the Inland Revenue for any tax and national insurance payments thereon.[3]Total award = £2,232.14[4]The Employment Protection (Recoupment of Benefits) Regulations 1996 do not apply.
