JUDGMENT

The name of the respondent is amended to that shown above. Both claims are dismissed

REASONS

[1]The claimants presented their claims on one form for unpaid wages and holiday pay The respondent filed a response saying all sums due had been paid. Various Employment Judges have given the claimants an opportunity in writing to dispute that but they have failed to answer. When the case was called on for hearing, they were not shown as having reported their presence in the building. The clerk checked in the waiting area and received no reply. Rule 47 says if a party fails to attend or to be represented at the Hearing, the tribunal may dismiss the claim or proceed with the hearing in the absence of that party. I concluded they had not bothered to attend having probably been paid what they were owed,. Without them here there was no opposition the respondent’s evidence they had been.
